Recovered assets will only be state property after a court decision, says Government

Assets recovered by the State will only be considered state heritage after they have been finalized in the courts, said the national director of State Heritage this Tuesday.

Adilson Sequeira was speaking, in Luanda, at a seminar on Budget Execution Rules 2022 promoted by the Ministry of Finance (Minfin), where he spoke about the assets that have been seized, seized and returned to the State, through voluntary surrender, within the scope of the processes of fight against corruption undertaken by the Angolan justice system.

Hundreds of assets, bank accounts, real estate and shareholdings in companies have been seized, seized or returned in the last five years, many of which belong to family members and others close to the former President, José Eduardo dos Santos.

The head of the National Directorate of State Heritage (DNPE) stressed that "the State's heritage only manages the State's heritage" and "what is not in the State's sphere cannot be managed, under the terms of the law, by the National Directorate of State Heritage", depending on court decisions in all cases.

In the case of seized assets (as happened with companies owned by Isabel dos Santos, daughter of the former President), in the case of a precautionary measure, they remain legally within the sphere of the holder who, however, is prevented from selling his assets.

"The objective is to safeguard the interests of the State and not allow the person being investigated to use the property or sell the property," he explained.

Those who are apprehended, such as the temples of the Universal Church of the Kingdom of God (IURD) or the properties of the former boss of AAA Seguros, condemning last month, Carlos São Vicente, who "also do not belong to the State", are handed over to a faithful trustee.

"After becoming final, if the judge deems it so, that the assets are reverted in favor of the State, then, yes, they enter the legal sphere of the State and the management of the DNPE", said Adilson Sequeira.

The final decision refers to the moment when a judicial decision is no longer subject to appeal and becomes final.

The trustee "has to create conditions to keep the property in conservation" which means that they can be leased, in the case of real estate, or used so as not to degrade, such as vehicles, exemplified the same official.

Those that are voluntarily handed over by their owners, as part of their collaboration with the law (such as buildings and companies handed over to the Attorney General's Office by Generals Dino and Kopelipa) also require "a verification", since the delivery term must be authenticated by a notary and this authentication document must be approved by a court, and from there it can enter the sphere of the State.

The Minister of Finance, Vera Daves de Sousa, stressed at the opening of the seminar, aimed at Minfin staff, the growing responsibility of public managers and the need to "continuously improve the quality of public expenditure, so that each kwanza or dollar collected has the best possible destination and with an impact on the life of every Angolan".

Along the same lines, the Secretary of State for Budget and Public Investment, Aia-Eza da Silva, intervened in the closing.

"We want to reinforce the need for budget discipline and compliance with all the rules of budget execution, revenue and expenditure", she said, regretting the poor adherence to the seminar, which she considered "very worrying".
