Ministry of Mineral Resources, Oil and Gas approves new regulation for fuel exports

The Ministry of Mineral Resources, Oil and Gas approved a new regulation for the export of fuels, which will be defined “in accordance with the public interest”, with a view to controlling transactions and countering fuel smuggling.

The preamble of the diploma highlights the "high volume of fuel smuggling verified at national land borders, as well as the illegal transactions found" that require "the redefinition of the control mechanisms in force, in order to make them more efficient and effective".

The regulation establishes that the export of fuels can only be carried out by licensed operators and is subject to prior authorization issued by the Petroleum Derivatives Regulatory Institute (IRDP).

"The authorization for the export of fuels from the storage facilities is defined according to the public interest and taking into account the border regions" and is subject to customs duties, fees and surcharges, according to the executive decree.

The fuel share of the imported volume destined for export will be determined according to the market share of each agent authorized and certified by the IRDP, provided that it is not less than 5 percent.

On the verge of a fuel shortage in the country, the ministers of Petroleum, Finance and Industry and Commerce will be responsible for defining the reduction or suspension of the planned quota, depending on the severity of the crisis.

Information on the volume of fuel exported may be shared with other entities and must be reported by the tax authority on a quarterly basis to the IRDP for monitoring and control purposes.
