Association regrets that PR was limited to the MPLA in the Constitutional revision proposals

The Justice, Peace and Democracy Association (AJPD) considers that the President should have listened to natural and legal persons with a different opinion than his party before presenting the proposal for a revision of the Constitution.

In taking a position on the constitutional review process, AJPD considers that the processes of implementing a new Constitution or constitutional review must pass the examination of two rules: "procedural goodness" and "material goodness", of the content that you want approved.

"The goodness of the procedure must necessarily involve the creation of de facto spaces for participation for those represented to be heard and the provision of sufficient time for that purpose, in a public discussion that produces consensus", they refer in the position taken.

Regarding the material goodness of the content, AJPD argues that it requires that the amendments to be approved do not annihilate the identity of the democratic and legal state, considering that "what was proposed in relation to the judiciary threatens identity".

For the organization, in the light of the Constitution, the proposal for a constitutional review by the head of state "cannot in any way suspend or limit the legislative power with regard to his competence to introduce new matters for review, within the framework of the proposal of the President".

"The constitutional power of constitutional revision is attributed to the deputies and the deputies of the National Assembly", underlines the document.

In this sense, AJPD urges the President of the Republic, who is also the leader of the party with a parliamentary majority "to correct the lack of representation and democracy that the process of constitutional review of its initiative already suffers".

The National Assembly approved, Thursday, by a qualified majority of more than two-thirds, the proposal for a punctual revision of the Constitution of the Republic, requested earlier this month to parliament by the President.
