Government says deep revision of the Constitution would create instability in the legal system

The head of the Civil House of the President of the Republic said that making profound reforms to the Constitution would introduce instability in the country's legal system.

Adão de Almeida responded to the deputies in the National Assembly, within the scope of the discussion and approval of the proposal for a punctual revision of the Constitution of the Republic, requested by the head of State, João Lourenço.

In the speeches, several deputies considered that this is an opportunity to review other issues that concern society, as defended by the deputy of the parliamentary group of the National Union for the Total Independence of Angola (UNITA) Alcides Sakala.

For Alcides Sakala, this would be the time to revise the question regarding the direct election of the President of the Republic, his powers considered excessive, the alteration of national symbols, the strengthening of the powers of inspection of the National Assembly, the incompatibility of the President of the Republic , provincial governors, municipal and communal administrators with party functions and the introduction of the parity composition of the National Electoral Commission (CNE) in the Constitution.

According to Adão de Almeida, a state cannot afford to make profound reforms of the Constitution in ten years. "It introduces instability in the legal system. Today, even with the punctual revision, there is a set of laws in the National Assembly, or they were recently approved, they will have to be discussed again, or, being in discussion, they have to stand still until the revision is approved. of the Constitution ", he stressed.

As an example, Adão de Almeida cited the draft law of the National Bank of Angola, which is part of the constitutional review proposal, providing for his independence from the executive branch.

"It is under discussion here [draft law of the National Bank of Angola], at this moment it seems to me that the warning is not to change that law until we know how the text of the Constitution will be," he said.

The Law on the Functioning of Courts and the Court of Auditors recently approved, still without promulgation, continued Adão de Almeida, under the terms in which the Constitution is approved "can change a law that was recently changed".

"In other words, changing the Constitution alters the legal system, the greater the depth of the change, the greater the instability that is introduced in the legal system. We are now including the vote abroad, this proposal, being approved, has to change the Law on General Elections, we have to change the Law on the Electoral Register ", he pointed out.

"Therefore, more depth or less depth depends on the level of stability that we want to introduce into society and, we have no doubts, moving the Constitution a lot at this time implies stopping everything again, opening a great process of discussion and consultation and after the approval of the Constitution to restructure everything that is down there ", he added.

The proposal for a punctual revision of the Constitution of the Republic, on the initiative of the President, submitted to parliament earlier this month, was approved with 157 votes in favor, zero against and 48 abstentions by UNITA and deputies not included in parliamentary groups.
