Aenergy and General Electric reach agreement in the United States

The electric company Aenergy and General Electric (GE) reached an agreement, putting an end to processes related to contracts signed with the Angolan government that were being processed in North American courts.

According to an official source, four legal actions were underway, in different jurisdictions, related to the payment of compensation for damages caused by the termination of contracts and falsification of documents.

Aenergy withdrew the process after reaching an agreement, the terms of which are confidential, with GE, according to a document to which Lusa had access.

The case concerns 13 contracts signed between Aenergy and the Ministry of Energy and Water (Minea), in 2017, for the construction, expansion, requalification, operation and maintenance of electricity generation plants in Angola.

In 2017, the energy company, led by Portuguese Ricardo Machado, was contracted to build and operate several state-owned plants, and should be financed through a 1.1 billion dollars credit line with a unit of General Electric (GE) , which stipulated that AEnergy purchase eight GE turbines for those plants.

Aenergy has been involved in litigation with Angola since the Angolan executive terminated in 2019, several contracts with the company alleging breach of trust due to alleged irregularities, accusations that the electricity company rejects, guaranteeing that it had alerted the supervisory ministry and had carried out several projects without receive payment.

In December 2019, four of the company's turbines, parts and consumables were seized from Aenergy, as part of a precautionary measure brought by the National Asset Recovery Service of the Attorney General's Office due to "indications of breach of contracts".

For its part, the company accuses the Angolan State of "illegal and unfounded expropriation" of the turbines and other equipment.

In the lawsuit filed in May 2021, Aenergy alleged that GE falsified documents to defame the electricity company and take over its work and accused the Angolan Government of agreeing to the scheme so that it could cancel the contracts before full payment and seize the turbines in your benefit.

Recently, a North American federal court refused to re-evaluate the electricity company's case against the Angolan State, concluding that there is no new evidence, after having granted a petition from Angola to reject Aenergy's action.

In April 2022, the North American court refused to judge the lawsuit filed by Aenergy against the Angolan State, referring the case to Luanda.
