Parliament approves new building legislation to "reduce conflicts"

This Friday, Angolan deputies generally approved the proposal for a Law on the Legal Regime of the Land Registry, which should "reduce ownership conflicts" of rustic or urban buildings that "still persist" in Angola.

The law, on the initiative of the holder of the executive branch, was approved with 161 votes in favor, no votes against and seven abstentions during the second ordinary plenary session of the fourth legislative session that continues in parliament.

The Government says, in the preamble to this law, its concern is the "legal uncertainty currently existing" in relation to the "correct identification of the buildings, including their location, with direct and immediate reflexes in the increase of conflicts related to ownership".

The document approved in general, whose appreciation should happen later in the parliament's specialty commissions, aims to establish the basic methodology and the rules for the execution, renewal and conservation of the cadastre.

For the deputy of the parliamentary group of the Wide Convergence of Salvation of Angola - Electoral Coalition (CASA-CE), Alexandre Sebastião, the law, now approved, must "solve the conflicts of ownership" that are registered by the country.

"For us, this proposal for a law also has the fundamental aim of broadening the tax base," he said.

UNITA deputy José Eduardo said at the time that the proposed law is an "indispensable legal instrument" for the development of the country's economy and that it will enable citizens to "economically value" their good.

According to the politician of the National Union for the Total Independence of Angola (UNITA), in opposition, the land register "will discourage real estate speculation, promote the development of local authorities and the equitable collection of fees".

The deputy of the Popular Movement for the Liberation of Angola, Virgílio Tchova, considered the land register as a "structural policy measure" of the government for the "guarantee of legal certainty and security of property rights".

The MPLA deputy added: "It seems to us unquestionable, even unavoidable, the importance of the registration of buildings and, although the measure is late, it is better late than never and here we have it."

The Law on the Legal Regime of the Land Registry establishes that each registered building is identified through a numerical code, called Land Identification Number (NIP).

"The NIP is assigned by the Central Registry Service. The use is mandatory in all public documents as a way of identifying registered buildings", reads the legal diploma.

The minister of Public Works and Spatial Planning, Manuel Tavares de Almeida, told the deputies that the register will do the "accurate registration of the property, be it land, buildings or buildings".

"Accurate registration to avoid conflicts, giving legal certainty is the object of this law", he noted, arguing that the concept of rural and urban building or rustic land will be defined by the Land Law, under review.

According to the official, if the law passed today had already been in force "we would have an obligation to better organize the property, as it is being presented now we will have to find ways to better organize it".

The importance of the NIP was also highlighted by Manuel Tavares de Almeida, referring that it will deserve "constant updating", the number of which, he explained, "will be unalterable".
