According to presidential decree No. 237/21 of 23 September, signed by João Lourenço and which Lusa had access to this Wednesday, the extinction of Inavic and the creation of ANAC are part of the fulfillment of international obligations.
Without prejudice to the powers provided for in the Civil Aviation Law and other applicable rules in force, the decree states, the attributions, powers, powers for the revocation, approval, publication of administrative, financial, regulatory, regulatory and the Inavic's staff.
ANAC succeeds Inavic in the ownership of all legal, conventional, administrative or contractual rights and obligations that are part of its legal sphere.
"This diploma does not extinguish the administrative, regulatory or regulatory acts carried out by Inavic that are in force", reads the presidential order.
The legal diploma also determines the automatic transition of all Inavic's account balances to ANAC's accounts, as well as all the assets, inventory, infrastructures, assets, as well as the liabilities of the extinct body to the new entity.
Employees of the permanent staff of the extinct Inavic, including those who are on probationary basis, as well as other employees who at the date of entry into force of this statute are in demand or on a service commission, "have the right to enter into an employment contract for an indefinite period, considering for reasons of public interest assigned to ANAC".
The legal-employment relationship established with employees who are transferred or transferred from Inavic to ANAC "fully respects the rights acquired in terms of salaries and social benefits earned by these employees in the previous employer", the document observes.
A transitional council, composed of members of the board of directors of the defunct Inavic, temporarily assumes all the functions of management, establishment and implementation of the organic statute of ANAC, until the board of directors of the new body is appointed.
