Death of JES: criminal court is not competent to decide delivery of body to ex-wife

The daughter of former president, Tchizé dos Santos, this Thursday appealed the court decision that delivers her father's body to his ex-wife and argues that the process is civil and not criminal.

:

"The current process is not, and cannot be, the appropriate place to decide the fate of Mr. dos Santos' mortal remains, on the contrary, civil law is the appropriate one and must be used to determine who has the legitimacy to receive the mortal remains. of the deceased and to decide on the place of burial", reads in the appeal presented in court, and to which Lusa had access.

In the text, the lawyer of Tchizé dos Santos, who was refused this week to receive the remains of former president José Eduardo dos Santos, also argues that there is an open process on this issue, and therefore it cannot be a court to decide on a civil matter, since the criminal court must focus only on the causes of death, which Tchizé dos Santos attributes to the lack of medical follow-up in the last days of his father's life.

In the text, Tchizé dos Santos points out that Ana Paula dos Santos herself admitted to being legally separated from José Eduardo dos Santos since 2017 and, therefore, is not entitled to receive the body.

"What is, from any point of view, evident, is that Mr. dos Santos and Mrs. Ana Paula were not in a stable relationship as a couple", which means that the former wife cannot be considered a widow of José Eduardo dos Santos, it is alleged.

José Eduardo dos Santos, who ruled Angola from 1979 to 2017, died on July 8, aged 79, in Barcelona, Spain, where he has spent most of his time for the past five years.

Two factions of the dos Santos family dispute, in the Family Court of the Civil Court of Catalonia, who will have custody of the body of José Eduardo dos Santos.

On the one hand, there are Tchizé dos Santos and his older brothers, who oppose the delivery of the remains to the former first lady and are against holding a state funeral before the 24 August elections in Angola to avoid political exploits.

On the other side is the widow Ana Paula dos Santos and her three children in common with José Eduardo dos Santos, who also claim the body and want it to be buried in Angola in the near future.
