MP ordered the “Man-Genas” smuggling case to be archived

The Public Prosecutor's Office ordered the shelving of the case involving Angolan whistleblower Gelson Quintas “Man-Genas”, indicted for the crimes of smuggling and criminal association, due to lack of evidence, according to an order consulted this Tuesday by Lusa.

"Man-Genas", detained since last February in Luanda after being deported from Mozambique, was listed, together with co-accused Abel José Joaquim, in a case relating to crimes of fuel smuggling and criminal association.

According to the MP, in an archiving order to which Lusa had access this Tuesday, "there is no evidentiary evidence in the file to accuse them of committing the aforementioned crimes", arguments reaffirmed by the defense that requests the immediate release of "Man-Genas".

Gelson Quintas, who last year denounced the alleged involvement of senior figures from the national police and the Criminal Investigation Service (SIC) in drug trafficking networks and fled to Mozambique, was expelled from the Indian Ocean country and returned to Luanda, finding himself been detained since February.

The complainant, who has already served a sentence for drug trafficking, is accused, in another case, of the crimes of outraging the State, its symbols and organs and slander and defamation, to which the MP's archiving order makes no mention, ordering, however, the release of "Man Genas" and the other co-accused.

The order, which focuses its arguments on the crimes of fuel smuggling and criminal association, lists the lack of evidence that supports the attribution of facts that constitute a criminal offense, as well as the lack of constituent elements of the crimes, to justify the archiving.

"As there is no indication of applicable legal precepts and of the steps taken in the preparatory investigation phase, it was not possible to determine the existence of the offense in relation to the defendants", reads the document, which orders the archiving of the case and the promotion of the release of "Man-Genas".

To Lusa, "Man-Genas's" lawyer, Francisco Muteka, applauded, this Tuesday, the MP's decision, saying that the entity understood that, depending on the evidence presented in the process, the evidence was quite fragile and, therefore, Therefore, there was no substance or consistency to take the accused to court.

"Once this was done, the MP and here also the defense with requests and certain acts that were carried out (...), it was concluded that the process had to be archived, taking into account the lack of elements that could support an accusation", stressed the lawyer, asking for the immediate release of "Man-Genas" and his return to family life.

Francisco Muteka also promised to "monitor every step of the way" in this process, so that the guarantees of "Man-Genas" are ensured, in light of the principle of a fair, equitable and democratic process.

Regarding the crimes of outraging the State, its symbols and organs and slander and defamation attributed to "Man-Genas", the source said they are part of another process, which must be addressed at another time.

In a statement released in February, after the deportation of "Man Genas", the SIC revealed that the complainant was the target of two arrest warrants for crimes of qualified theft and abuse of trust and was also responsible for crimes of outraging the State, its symbols and bodies, public incitement to crime, defamation, insult and slander.

"Man Genas" was expelled from Mozambique for illegal entry and stay in the country, having returned to Angola with his wife and children.

The Angolan published on social media complaints about the alleged involvement in drug trafficking of several Angolan figures, including the President of the Republic, government officials, general officers and commissioners, later taking refuge in Mozambique, where he requested asylum, a request rejected for not having been granted. the persecution of which he claimed to be a victim was proven.

According to the SIC statement, the intention was to "dismiss criminal liability", an attempt that was unsuccessful and led the complainant to "stand up against the Mozambican authorities".

Once expelled, "Man Genas" and his family were banned from entering Mozambique for a period of ten years.
