Magistrates prohibited from carrying out legal proceedings

The Superior Council of the Judiciary (CSMJ) prohibited magistrates from carrying out proceedings in place of bailiffs, except in cases of “enormous probative value”.

In a circular signed by the president of the institution, Joel Leonardo, the CSMJ states that "some magistrates have carried out these steps", behavior that they consider to be "not recommended", as it demonstrates "interest in the case and violates the principle of impartiality".

Thus, "the carrying out of inspections not in accordance with the law and outside the courts by judicial magistrates is expressly prohibited" determines the CSMJ, safeguarding "those that appear to have enormous probative value for the good decision of the case", when the law allow it.

The circular does not provide further details on the matter.
