Court of Auditors contests vice-president of curricular contest sentenced to return 29.9 million kwanzas

The Court of Auditors (TdC) considers that Carlos Cavuquila, member of the Judiciary, condemned to return 29.9 million kwanzas to the Angolan State, “is prevented” from being vice-president of the curriculum competition jury.

Carlos Caviquila, member of the Superior Council for the Judiciary (CSMJ), was appointed by the body, last week, as vice-president of the jury of the curricular competition for the recruitment of five judges of the Court of Auditors.

His nomination is contested by the TdC plenary in a decision dated May 8, 2023, which Lusa had access to this Wednesday.

According to the decision, Carlos Cavuquila has two cases pending, one of which has become final, condemned to reintegrate the value of 29,917,164.93 kwanzas to the State, and which is being executed at the Provincial Court of Luanda.

Another process involving the said entity is being processed by the 2nd Chamber of the TdC, "impending the procedure for sanctioning and reintegrating financial responsibility in an approximate value of 1.4 billion kwanzas and 177 million kwanzas, respectively".

"It seems to us that, being in the presence of these two pending cases, one with an effective conviction and the other pending, Dr. Carlos Caviquila is prevented from carrying out the mission for which he was assigned", refers in the note.

For the judges of that instance, "it would not even be necessary for the plenary of the Court of Auditors to bring this matter to light, since, knowing as you know, the target is a taxable person in those two lawsuits against the State, for which reason he should have declared immediately impeded for the performance of such a relevant mission".

The TdC judges also suggest that the competition jury integrates an advisor judge from that court, "as has happened in previous competitions, taking into account the specificity of the body".

According to the plenary of the Court of Auditors, acceptance of the aforementioned suggestion "would give greater transparency and credibility to the competition itself and would reflect the TdC's needs in the composition of its judges, taking into account the memorandum that was delivered to the CSMJ".

"For all the above, the plenary of the Court of Auditors requires that the inconsistencies exposed above be corrected, as appropriate, by the Superior Council of the Judiciary", it also refers in the deliberation.

The CSMJ announced, last week, the opening of the curriculum public tender for the recruitment of five judges of the Court of Auditors.

Carlos Cavuquila was nominated for vice-president of the jury, which is chaired by the advisory judge of the Supreme Court, Daniel Modesto Geraldes, and also counts on the presence of the member of the CSMJ José Lobão Cosme.

The presiding judge of the Court of Auditors, Exalgina Gamboa, resigned last March and was subsequently accused of extortion, embezzlement and corruption.
