Workers with children up to 12 will be able to stay at home while a state of calamity prevails

Women who are employed under employment contracts and have children under 12 will be able to stay at home as long as the state of public calamity persists.

Citizens who "have custody of children under 12 years of age, when they have a work contract with a public or private entity, which must provide services during the period of the Public Disaster Situation, are exempted from face-to-face work while the fence or cordon sanitaire is in force, and must be subject to the regime of work at home", can be read in point 2 of Article 15 of the presidential decree that establishes the legal standards to be applied in the country during the state of public disaster.

However, it is not only working mothers with children under 12 who are covered by this measure. According to the document, pregnant women, people who suffer from a chronic disease considered to be at risk such as "kidney disease, hypertensive people, diabetics, cardiovascular patients, chronic respiratory patients and cancer patients" and people aged 60 or over have the right to stay at home or work from home while this stage is in force.

Public office-holders, health professionals, traffic and mobility support operators, and members of the Defence and Security Bodies" are not covered by this measure, he adds.

The state of public calamity came into force this Tuesday. After two months in a state of emergency, the country has begun to alleviate some of the measures taken so far to prevent the spread of covid-19.
