Parliament approves Constitutional Court's organic law proposal

This Thursday, the parliament approved the proposed organic law for the organization and functioning of the Constitutional Court (TC), with 122 votes in favor, six against and 51 abstentions.

The Popular Movement for the Liberation of Angola (MPLA), the Social Renewal Party (PRS) and the National Front for the Liberation of Angola (FNLA) voted in favor of the proposal.

The CASA-CE coalition (Convergência Ampla de Salvação de Angola - Coigação Eleitoral) voted against, with 51 abstentions from UNITA (União Nacional para a Independência Total de Angola) and independent MPs.

In its explanation of vote, the UNITA parliamentary group expressed that the model of composition of the Tribunal that the law proposes, especially with regard to the appointment of the president and vice-president of this sovereign body "does not favor the full autonomy of the TC in relation to other powers," nor the system of checks and balances "indispensable for the regular functioning of the democratic state and the rule of law.

He also argues that the matters dealt with by the Constitutional Court have a high public interest and should be widely publicized, while judges and their way of thinking and justifying their judgments should be subject to the scrutiny of the general public, aspects that he intends to address during the discussion in the specialty.

Among other aspects, the proposal reorganizes the scope of the TC's powers, with emphasis on the powers to assess the regularity and validity of municipal elections, the legality of the formation of coalitions and groups of citizen voters competing in municipal elections, as well as the declaration of their extinction, as well as those of judging appeals relating to the loss, substitution, suspension and resignation from office in municipal assemblies.

The parliament also approved the Constitutional Process bill, with 170 votes in favor (MPLA, UNITA, FNLA and one independent), and 12 abstentions (CASA-CE and six independent).

The proposal clarifies some rules of procedure and procedure in the various processes subject to the jurisdiction of the Constitutional Court.

The work of the 4th extraordinary plenary session of the 4th Legislature continues on Friday with the discussion of the draft law reprising the rules of the Code of Civil Procedure and Criminal Procedure on appeals, the draft law amending court and court fees, and the draft resolution approving the National Assembly budget for 2021.
