Chivukuvuku political party has three months to make up for flaws in its membership

The Constitutional Court gave Abel Chivukuvuku's PRA-JA Servir Angola Installing Committee three months to submit additional documents for its registration as a political party.

As part of the registration process, the commission delivered 23,492 signatures to that court in November, of which 19,495 were invalidated and therefore did not reach the 7500 signatures required by the Law on Political Parties.

The order of the Constitutional Court, dated 23 December, arises in response to a complaint of the Installation Commission about the first order of the Court, dated 13 December, regarding the result of the examination of the supporting documents for the application for registration.

In its complaint, the Installation Commission of PRA-JA Servir Angola requested the court to return all cases with signatures considered non-compliant, to prove "that the Constitutional Court is acting in bad faith, in pursuit of a specific group of citizens".

In response, the court states that the verification of signatures is a procedural component, not inserted in the previous phase, but in the registration phase, conducted by the Constitutional Court, and therefore, in the context of the Constitution and current laws, there is no duty to return documents or the right of an installer commission to judge and validate signatures within its own political party registry.

According to the Order, "the above mentioned legal diploma forbids the verification of signatures and documents by the installation commissions".

Accordingly, the court set the installation commission a deadline of three months "to submit to this court the additional documents defined by law for its registration".

In the document, the court alleges that along with Malanje's signatures, the Installing Commission presented numerous subscriptions accompanied by voter cards of citizens residing in the provinces of Kwanza Sul, Bengo, Huila, Cuando Cubango, Bié, Lunda Norte, Namibe and Benguela.

At a press conference, after the court had been notified of the alleged irregularities detected in the registration process, one of the members of the Installation Commission, Xavier Jaime, considered the court's allegations to be "false", pointing out that the municipal administrations had refused to issue certificates of residence on presentation of the voter's card.

Abel Chivukuvuku, the coordinator of the Installation Commission, said that "the Constitutional Court does not do jurisprudence, it does politics, they eventually receive orders to do what they have done".

"I feel sorry for my country. Whatever the picture, we will participate in the political life of this country. Trying to stop the PRA-JA or whatever it is, it won't work," he said.

Abel Chivukuvuku led the Broad Convergence for the Salvation of Angola - Electoral Coalition (CASA-CE, opposition) party until February 2019.
