Government approves simplified regime for micro, small and medium companies

The Government approved a simplified regime for Micro, Small and Medium Enterprises (MSME) to facilitate access to support policies and the formalization of economic activities.

According to the presidential order to which Lusa had access, the aim is to promote the debureaucratization and simplification of access to incentives and support to MSMEs.

MSMEs will now have access to a simplified incorporation procedure that can be requested at any Guiché Único da Empresa (Single Business Counter), regardless of territorial jurisdiction.

Sole proprietors will only have to fill out an application at the registry office.

Access to support and tax incentives can only be made by companies that "prove to have tax obligations fully settled" and the MSMEs will now benefit from "support for the resolution of bureaucratic constraints" with a body created for this purpose.

The law also introduces new features in inspection, with MSMEs and sole traders now having the right to receive a notification before fines are fixed, which will be made "in a pedagogical way" the first time they are found to be in default.

MSMEs will also have differentiated treatment in public procurement and large contract works.

The State and other public entities must devote at least 25 percent of their budgets to the acquisition of goods and services from MSMEs, and a reserve of 25 percent is also mandatory for the execution of public works contracts, under public tenders and by prior qualification.
