Superior Council of the Judiciary initiates an investigation against an adviser judge

The Superior Council for the Judiciary opened an investigation against Judge-Counselor Agostinho António Santos, a candidate unsuccessful in the competition for president of the National Electoral Commission (CNE), due to his statements about the process.

In a resolution dated 11 March, to which Lusa had access, the CSMJ explains that the judge's stance was analyzed in plenary, namely his statements on the results of the contest, which was won by Manuel Pereira da Silva “Manico”, as well as on the judicial processes and supposed information that would have been provided by the President of the organ.

The contest was not without controversy, with attempts at impugnation and precautionary measures, all rejected, and the nomination of “Manico” was approved in the National Assembly only by the ruling party, the MPLA, before the protest of all opposition parties, who abandoned the opposition. plenary room.

In an audio released on social networks and in the media, Agostinho António Santos threatened to hold the president of the Supreme Court (TS) and the Superior Council for the Judiciary, Judge-Counselor Joel Leonardo, criminally responsible, who accused of having sent a note communicating to the National Assembly that would have given up all the actions it brought against the selection process that excluded it.

The CSJM judges deny, however, that the president of this body has sent this information to the National Assembly.

On the other hand, they clarify that three letters were sent, informing the National Assembly of the nomination of the winner of the contest for president of CNE, on January 15th, having sent an addition, five days later, after having verified “an arithmetical error in the counting the results of the curriculum contest ”.

They add that another letter was sent to the President of the National Assembly, noting that the Supreme Court had received three precautionary measures, asking for the suspension of the act of inauguration, brought by Agostinho António Santos, which was dismissed.

The CSJM concludes by asking judicial magistrates to guide their conduct in accordance with the principles contained in the Statute of Judicial Magistrates.
