Court orders Northern Council to refrain from disturbing the Order of Doctors

The Luanda court upheld the precautionary measure brought by the President of the Order of Doctors (Ormed) against the Northern Regional Council of that body, ordering them to abstain from "acts that disturb the normal functioning" of Ormed.

The sentence to which Lusa had access, dated 11 February, states that "a group of associates attached to the Northern Regional Council has been practicing acts tending to destabilize the normal functioning of Ormed" pointing out among these: information put to circulation on social media about the holding of a general meeting, a letter addressed to the Minister of Health, the creation of a provisional management commission, invasion of the Order's premises accompanied by journalists, etc.

The facts "given as evidently proven in general" are "not only likely to affect, but also affect Ormed's institutional credibility", but are also "objectionable", says the court, stressing that access to the exercise of power within institutions " must be done using normal and judicial means "and that the current mandate of the president remains in force until 8 April 2022.

Internal conflicts at Ormed have dragged on since last year and prompted public statements by Health Minister Silvia Lutucuta last month, who appealed to "common sense" for doctors to overcome the crisis.

The northern regional council of Ormed approved, on 17 October 2020, the dismissal of Elisa Gaspar, with new elections to be held in 90 days.

According to the resolution approved at the end of the extraordinary general meeting, in addition to dismissal, it was also decided to create a commission of inquiry to analyze irregularities and promote an independent audit.

Elisa Gaspar, who has served as president of Ormed for more than a year, is accused of "misappropriation of funds and harmful management" of the institution, including an alleged diversion of 19 million kwanzas, and "other unjustified expenses".

The court's sentence now orders the defendants (Northern Regional Council and five doctors, including the president of the Doctors' Union, Adriano Manuel and members of the management committee) to "refrain from practicing acts that disturb the normal functioning of the Order ", including forced reunion attempts, coercive receipt of keys, or impediment of any legitimate Ormed employee from accessing the premises, until the final decision in the main lawsuit through a court.

Defendants will also not be able to "invade Ormed's premises" or carry out any corporate management actions there, nor "promote acts of discord on social networks" or disseminate "insulting messages with unfounded accusations against Ormed and its president".

Finally, they must refrain from "taking any corporate bodies or material means" by assault of the Order or prevent their employees from performing acts in their direct interest until the "main and final decision".
