Court proves that José Eduardo dos Santos favored Isabel dos Santos business

The decision of the Luanda Provincial Court to arrest the assets of Isabel dos Santos highlights the crucial role played by former President of the Republic José Eduardo dos Santos in the diamond business of the daughter and her husband, Sindaka Dokolo.

It was also proved that "the former President of the Republic can invest in a Swiss company - De Grisogono/Luxury Jewelery - which finds a technical bankruptcy due to a debt to the banks UBS-Cantonale Bank of Geneva and BCV".

According to a precautionary measure of arrest, José Eduardo dos Santos chose to buy a debt of the company De Grisogono/Luxury Jewelery from banks and "offer the business to Isabel dos Santos and Sindika Dokolo, his daughter and son-in-law."

"In return for the deal, the owners of the Grisogono/Luxury Jewelery company would give in to their social participation to Sodiam EP and Isabel dos Santos and Sindika Dokolo, through vehicle companies", advances the document, that proved that "the former President of the Republic instructed Sodiam EP to enter into the business assuming all charges inherent therein".

Victoria Holding Limited was immediately established in Malta with a share capital of 3,000 euros, whose partners were Sodiam EP, at the time with 50 percent of the shareholdings and Exem Mining BV with 50 percent of the shareholdings. Was proven that the company Exem Mining BV "was controlled by Isabel dos Santos and Sindika Dokolo", being Mário Filipe Moreira da Silva the general manager of the company Victoria Holding BV.

The Luanda Provincial Court also found that the loan amount granted by BIC bank to Sodiam EP served to finance De Gridogono and Victoria Holdin BV.

According to the court, in possession of the new financing, on December 8, 2015, Sodiam EP transferred to the company Victoria Holding Limited US 23.7 million dollars and, by decision of the executive, José Eduardo dos Santos the remainder of the financing amount, was used to repay debts to four mining companies, with the aim of increasing their diamond production and making Isabel dos Santos and Sindika Dokolo's business profitable abroad.

Also proven, according to the court, José Eduardo dos Santos advised Sodiam EP to sell diamond-related companies to their daughter and son-in-law "at a lower price than the market, causing damage to the state company (Sodiam EP)".

"The defendant-related companies Iaxhon, Relactant, Odissey, Nemesis International (Isabel dos Santos, Sindika Dokolo) subsequently sold diamonds abroad and made huge profits without the state having any visibility into these advantages".

It was also proved that Isabel dos Santos and Sindika Dokolo "have opened several luxury stores in various parts of the world, notably Dubai, Switzerland, the United Kingdom, the United States, the Dominican Republic and France", and "Sodiam EP had a lot of financial difficulties to pay BIC credit and risk bankruptcy ".

The Luanda Provincial Court also proved that Isabel dos Santos and Sindika Dokolo "are hiding the assets obtained at the expense of the state by transferring them to other entities".

It was also proved that Isabel dos Santos, through its partner Leopoldino Fragoso do Nascimento, "is trying to transfer some of its business to Russia, and the Portuguese police intercepted a 10 million euro transfer to Russia".

On balance, it also proved that Isabel dos Santos, Sindika Dokolo and Mario Silva damaged the state by more than 1.1 billion dollars.

The seizure was brought by the National Asset Recovery Service against Isabel dos Santos, Sindika Dokolo and Mário Silva.

Isabel dos Santos says that the process has political motivation

In reaction to the court's position, businesswoman Isabel dos Santos said on Tuesday she was never notified or heard in the investigation that led to the seizure of her accounts, denying accusations that she is targeted in a case she claims is "politically motivated".

"This ruling is the result of a judgment of an injunction, which took place without knowledge of the parties, in a seemingly arbitrary and politically motivated manner. Not understanding or being able to comply with this framework in a democratic rule of law such as Angola, Isabel dos Santos intends to oppose each of these allegations in its own time and place under the terms established in Angolan law ", reads the statement of Isabel dos Santos, daughter of former President, José Eduardo dos Santos.

Isabel dos Santos claims to be unaware "when the witnesses' hearing referred to in the order was sentenced, their identity or any other alleged evidence brought to the proceedings".
