Competition regulator registers 21 cases of restrictive practices in four years

At least 21 cases of practices restricting competition have been analyzed in the last four years in Angola, most of which have been archived and some are pending investigation, and 41 merger operations between companies have been registered, announced the regulator.

The information was advanced this Wednesday by the administrator of the Regulatory Agency for Competition (ARC), Ana Ramalheira, noting that some processes were archived "because they were only complaints and not competition matters".

"And we have some openings of investigations, an inspection is currently underway in a segment of the food sector and we have a sectoral investigation underway in the civil construction sector as well, we still do not have any condemning decision, they are very long processes and that have several stages," she said.

The telecommunications, finance and food distribution sectors are the main targets in the processes.

Speaking at a press conference to review the four years of existence of ARC, institutionalized on December 21, 2018, and to present the body's III Annual Conference, the official also pointed out the process of company concentrations.

In the field of control and mergers of companies, she underlined, there have already been "41 operations notified to the ARC since 2019, acquisitions, mergers or creation of joint ventures, and most of them obtained a non-opposition decision from the ARC".

"They did not present elements likely to harm competition and then we have two that were approved with compromise because we identified some concerns, that is, they were approved, but with conditions, basically it is the preventive control that we do to avoid abuse of power in the market ", she explained.

"Our main objective is the promotion of competition in Angola and the fight against restrictive practices and the quality and effectiveness of concentration control, which is an area that has to do with the preventive function of the ARC", explained Ana Ramalheira.

The ARC holds on Thursday, in Luanda, the III Annual Conference on Competition and Economic Regulation in Angola, to mark its fourth anniversary.

Presenting an assessment of the implementation process of the Competition Legal Regime, assessing the achievement of the objective of promoting and defending competition and the National Competition and Economic Regulation Policy are some of the topics scheduled for the meeting.

The competition regulatory body in Angola has regulatory, supervisory and sanctioning powers, in light of its organic statute.
