Ex-PM says amnesty bill serves to “clear” deviations from the treasury

Former Prime Minister Marcolino Moco considered this Thursday that the amnesty bill will only serve to “clear those who continue to divert the treasury to their accounts, very regrettably abroad”.

"Their names are known, I won't say because everyone knows them, they are close to the President. At first glance, these are the ones who will benefit from this law when it is approved", said Marcolino Moco, speaking to the Lusa agency about the proposal of amnesty law.

The proposal was approved on Tuesday by the Council of Ministers, to grant amnesty for all common crimes punishable by imprisonment for up to ten years, committed by nationals or foreigners, in the period between 12 November 2015 and 11 November 2022, with some exceptions in the types of crimes, including embezzlement and money laundering.

The politician said that he does not expect "much from this amnesty law", which, in his opinion, would serve people like José Domingos Mateus "Zeca Mutchima", leader of the Portuguese Protectorate Movement Lunda Tchokwe, the former Minister of Transport Augusto Tomás, political activists Luther King and Tanaice Neutro, among others.

Zeca Mutchima was sentenced to four years in prison for crimes of criminal association and incitement to rebellion, following incidents in Cafunfo, Lunda Norte province, during a demonstration that resulted in deaths.

The former Minister of Transport was sentenced to eight years in prison in the context of the well-known case of the National Council of Shippers, for various crimes, including embezzlement, while political activist Tanaice Neutro was sentenced to a suspended sentence of one year and three months for the crimes of outrage to the State, its symbols and organs, and also activist Luther King is arrested, accused of rebellion and resistance against official.

For Marcolino Moco, "if this law is serious" there would be "many pleasant news for certain families, for certain sectors of society".

"If I saw, for example, Zeca Muxima from the Lunda Norte case out here, he and his companions who are sick, some have already died in prison, if I saw him outside following this law I would be very satisfied", he stressed.

"If I saw Augusto Tomás out here, a man who was wronged, I don't know why the load of water - nobody knows what's going on in this case - if I saw José Filomeno [dos Santos, son of former President José Eduardo dos Santos ], out here - some say he is out - but we cannot hide from the country, this is a country for all, a property of all Angolans, we are not going to continually walk here in a process in which secrets of strange states," he said.

The former secretary general of the Popular Movement for the Liberation of Angola (MPLA) said that it would be interesting if this draft law promoted "the coming even of his sisters [of José Filomeno "Zenu" dos Santos, Isabel dos Santos and Tchizé dos Santos] that are out there, that could contribute to the development of the country".

Marcolino Moco stressed that the proposed law would be useful if it served to "create conditions for correcting the mistakes that were made with the persecution of the sons of President José Eduardo dos Santos, who have important elements for the country's development".

The former ruler is skeptical about the impact of this proposal: "I don't expect much, what I see is more manipulation to whitewash those who continue to do harm to the country and whiten the image of the regime's unpopularity," he said.

The proposed amnesty law does not cover intentional crimes committed with violence or threats to persons, which resulted in death or when there was use of a firearm, violent crimes, high-level drug trafficking, trafficking in persons or sex trafficking in persons, trafficking in weapons and war munitions, penetrative sex crimes, sexual crimes against minors or those committed through sexual aggression and crimes to promote and aid illegal immigration.

Crimes of embezzlement, money laundering, environmental crimes, those resulting from vandalization, destruction or deprivation of public goods, against the security of the State, which do not admit parole under the law, those of incitement to public disorder, to insurrection and coups d'état and crimes that are imprescriptible under the terms of the Constitution and the law are also not amnestied.

Likewise, property crimes, whose damages have not been repaired and assets that have been seized in criminal proceedings, which are now amnestied, are declared forfeited in favor of the State, are not covered or covered by this proposed amnesty law.

"The exception is that, if these assets are titled or owned by a third party, these assets are not lost in favor of the State and must be returned to their normal and common owner", said the Minister of Justice and Human Rights, Marcy Lopes.
