Government approves new oil law that provides for "angolanization" of the sector

The government approved new legislation for the oil sector that foresees less use of foreigners and an increasing "angolanization" of the workforce and the acquisition of goods and services.

The preamble of the law states that the law responds to the need to promote and encourage the participation in the oil sector of commercial companies owned by Angolans, as well as the acquisition of national goods and services and the promotion of local businesses and workers.

Presidential Decree 271/20, which establishes the legal framework for the promotion and development of local content in the oil sector, was published this Wednesday in Diário da República and applies to members of the national concessionaire and Angolan commercial companies that provide services and goods to the oil sector.

The law states that these entities must hire workers of Angolan nationality "to ensure the necessary professional training and the provision of salary and social conditions compatible with their qualification", as well as attract investment in research, development, technology transfer and training of the Angolan workforce.

The entities must purchase raw materials, goods and equipment manufactured in Angola and whenever they compete for the same service, Angolan commercial companies must be privileged.

The diploma also determines that they must hire national goods and services included in the list of goods and services on an exclusive basis previously defined by the national concessionaire (National Agency of Petroleum, Gas and Biofuels), after hearing the Competition Regulatory Authority.

Commercial companies in the sector may resort to the international market whenever the prices of national products do not correspond to the requirements of the petroleum activities law and may import them "upon presentation of evidence attesting to the difficulty or impossibility of acquiring them in Angola.

They must also prepare an annual plan of local content to submit to the national concessionaire.

In terms of human resources, commercial companies in the oil sector should sign a program contract with the respective ministerial department, containing the definition of knowledge of oil technology and management experience to be transferred to Angolan personnel and a description of the workforce forecast, among other requirements.

The non-acquisition of national materials, non-celebration of a program contract or non-inclusion of a local content clause in the goods and services contracts is punishable by fines between 50 thousand and 300 thousand dollars, and the activity may be interdicted for one to two years.
