Price fixing agreements between companies investigated by the Competition Regulatory Authority

A total of 18 cases of price fixing between companies are, since 2019, in the sights of the competition regulator. According to Nelson Lembe, administrator of the Competition Regulatory Authority (ARC), these processes are being investigated by the ARC, with a view to ascertaining whether the behavior was intended to limit competition in the market.

Explaining that the Competition Law forbids this type of agreement, the official did not name the companies targeted in the processes because they are covered by secrecy: "About investigation of conduct, this is the most confidential part, we cannot go into details about which sectors we are investigating, we only give numbers", he said, quoted by Angop.

However, he took stock of the operation that has been running since 2019. Of the 18 occurrences, three are still ongoing, 11 have been filed, four have led to the opening of an investigation and about seven have already been completed.

Cited by Angop, the ARC administrator also revealed the figures related to the acts of control of company mergers, also prohibited by the Competition Law.

Since 2018, the entity has received 29 participations in this type of practices - to determine the honesty of mergers and purchases of companies -, of which 24 were considered finalized and the remaining five are still ongoing.

Speaking at the "National Forum of Regulators", Nelson Lembe revealed that last year, despite the limitations due to covid-19, they received about 10 participations and that this year they have already registered eight cases.

He also mentioned the market studies, explaining that the entity conjectured three: one on the aviation domain in collaboration with INAVIC has already been completed and one is being finished with INACOM and one in the electrical field, writes Angop.

The complications in accessing information by the sector's competition regulators were regretted by the official.
