Parliament in favor of changing the rules for admission to the Supreme Court

The National Assembly approved this Wednesday, in general terms, the proposal to amend the Organic Law of the Supreme Court, which adjusts the rules for admission and the process for appointing judges, “without violating the Constitution”.

The proposal, presented by the Minister of Justice and Human Rights, Marcy Lopes, was approved unanimously with 178 votes in favor and aims to change some rules of the Supreme Court Organic Law, to improve and adjust its organizational and systematic coherence.

Marcy Lopes stressed that the objective is to improve the organization and functioning of the Supreme Court, essentially with regard to adjusting the rules for admission and the process for appointing judges to the Supreme Court, especially its president and vice-president.

According to the minister, candidates for both positions are currently nominated in a single and same competition, "in violation of the constitutional principle, which determines that the president of the Supreme Court and his vice-president are nominated by choice of the president of the Republic, after their election by the Superior Council of the Judiciary".

It is proposed to change the rule on the composition of the selection board for the entrance examination, also establishing the principle of separation or independent election of the president and vice-president of the Supreme Court, with these two figures being elected in different competitive processes.

The proposed amendment to this law proposes that judges who compete for these positions have a "good" performance evaluation over the last three years, while for deputy attorneys general of the Republic a minimum evaluation of "good" over the last ten years will be required.
