Proposed revision of the Constitution provides for "compelling reasons" for confiscation and nationalization

The proposals for revision of the Constitution that Angola is preparing to debate were revealed, in Luanda, by the Minister of State and Chief of Staff of the President of the Republic, Adão de Almeida, in a presentation shared with the ministers of Territory Administration, Marcy Lopes, and Justice and Human Rights, Francisco Queirós.

"The economic dynamics and, above all, the conflict between the economy and the law has led to measures being taken recently on goods that have been recovered and that is missing - and this is being felt - to frame the nationalization of certain goods that have been provenly acquired. with State appeal ", he justified.

With the change, the Leia is now able to punitively frame the reversal or inclusion of these assets in the State's assets, said the minister.

Francisco Queirós stressed, however, that the proposal imposes limits "since it only applies where there are ponderous reasons of national interest that will be defined in the ordinary law", and if these do not exist, nationalization cannot be applied.

As for confiscation, it can only be applied if there is a serious offense against the law that protects the state's economic interests, he added.

The constitutional revision proposal also introduces the category of community property "that does, in fact" exist, but has neither legal nor constitutional expression.

"We are now proposing that the concept be included in the Constitution to frame the production assets of rural communities, in view of the development programs that are defined for these areas of the economy and have found it difficult to confer ownership of the community production assets. members of the community ", justified the government official.

Another category proposed is that of the unstructured economy, including the informal and traditional economy, in view of its treatment for gradual introduction into the structured economy, said Francisco Queirós.

The timely revision of the constitutional law in force in Angola since 2010 was announced by the President of the Republic, João Lourenço, who has already sent the proposal to the National Assembly.
