Parliament approves law on the regime and form of municipal acts

This Thursday the parliament unanimously approved the law on the regime and form of local authority acts, a legal document that is part of the municipal legislative package, aiming at the first municipal elections, still to be scheduled.

The law passed in the sieve of Angolan deputies with 182 votes in favor, none against and no abstentions, during the second ordinary plenary meeting of the fourth legislative session of the National Assembly.

The country's first local elections were scheduled for 2020, but were not called due to the "impact of the pandemic" on the country, but opposition parties and civil society are demanding their "blunt timing.

In his explanation of vote, the deputy of the National Union for the Total Independence of Angola (UNITA), Simão Dembo said that his party voted in favor "because he believes that all legal steps leading to the full exercise of participatory democracy will deserve his full attention.

"We voted in favor even knowing that this law is not the one that determines the institutionalization and the holding of local elections, but if it represents a step forward, well said," he stressed.

MP MP MP Boaventura Cardoso said that his vote was in favor because the ruling party, 45 years ago, "is committed to the responsible approval" of the municipal legislative package.

"We approved the law because it is a fundamental instrument for the organization and functioning of local authorities. The Angolan people thus testify once again to the MPLA's political will, as well as that of the executive, in the materialization of local autarchic power," he noted.

The decree approved this Thursday applies to the deliberative and executive organs of the local government, namely the municipal assembly, the municipal council and the mayor.

According to the law divided into 13 articles, distributed in four chapters, the acts of local government bodies are subject to official publication in the Official Gazette, but the validity and effectiveness of acts of local government bodies "are not dependent" on this publication.

Without prejudice to publication in the official gazette, the law states that local government acts, such as announcements, notices, circulars, among others, may be published in other advertising channels, namely in the official website or posted in the local government offices.

"With the necessary adaptations, the structure of local government acts follows the regime defined in the general law on official publications and legal forms", reads the tenth article of this law.

This Thursday, the deputies also approved the law that amends the law on simplifying birth registration with 138 votes in favor, 45 against and one abstention, and the law that amends the legal regime of civil identification and issuance of the National Citizen Identity Card (BI).

This law, approved by the plenary of the Angolan Parliament with 129 votes in favor, 53 against and two abstentions, determines that Angolan citizens may have access to their ID card.

The parliament also appreciates, in this session, the law on plant health, the law that amends the Commercial Code and the law on the legal regime of the Land Registry.
