Marcolino Moco accuses the Presidency of consecrating “abnormalities” of justice

Former Prime Minister Marcolino Moco said that the Presidency is the “nucleus” for “consecration of abnormalities” in the country's organic justice system, for legalizing the PGR's dependence on the instructions of the President of the Republic.

Marcolino Moco, who spoke this Tuesday via zoom on "The role of justice in guaranteeing stability and sovereignty", during the International Conference on Peace, Stability and Development promoted by UNITA, pointed out a series of elements that he considered "degrading" of Angolan justice.

"The most worrying thing is that the most degrading elements of this justice, especially after the civil war that ended in 2002, were successively constitutionally and legally enshrined in the system, both political and strictly organic," said the politician.

According to the former secretary-general of the Popular Movement for the Liberation of Angola (MPLA), the "most decisive step" of "degrading" acts of justice in the country was the creation of a "hyper presidentialism" in the person of a head of state .

"Hyper presidentialism", he stated, brings together the executive power in the same holder, "however, removed from all formal and informal mechanisms of control and supervision of its acts", he said.

For Moco, it was easy, first for José Eduardo dos Santos, the constitutional and political "architect" of the current system, to begin a process of "dismantling organic justice, particularly in its ethical, moral and deontological foundations".

"What is now up to President (of the Republic) João Lourenço is to enjoy and continue, without any hesitation, the sadly monumental work of his predecessor", he criticized.

For the former MPLA leader, in what he called the "plan to consecrate abnormalities" in the organic justice system, "it is necessary to highlight the legalization of the dependence of the Attorney General of the Republic (PGR) on the instructions of the President of the Republic".

This, he stated, is "manifestly against the spirit of the institutional and functional autonomy of the Attorney General's Office and the Public Ministry, within the framework of any democratic State and the rule of law".

The jurist and former executive secretary of the Community of Portuguese Speaking Countries (CPLP) also pointed out "other elements of abnormality", within the scope of the judicial power, "systematically consented to by the judges themselves", such as "the sacrifice of the fundamental principle of constitutionally enshrined irremovability of judges", highlighting that there is no organic justice that under these conditions "can constitute a guarantee for national stability and development".

In Marcolino Moco's opinion, the "central nucleus of the destructive action" of Angolan justice "is the Presidency of the Republic itself".

"It is enough to remember the instructions that the President (of the Republic) João Lourenço gave, without any discretion, to the new president of the Court of Auditors, suggesting that it was not by chance that the previous holder of the position was removed, when more serious reasons relate to the irremovable president of the Supreme Court", he concluded.

The International Conference on Peace, Stability and Development was promoted in Luanda by UNITA, as part of the 42nd anniversary of World Peace Day.
