Carlos Feijó says that the Court of Auditors has a “true jurisdictional function”

The professor of law at Universidade Agostinho Neto (UAN) Carlos Feijó said this Tuesday that the country's Court of Auditors (TC) has a “true jurisdictional function” and “there are no doubts” about its organic criterion.

"We have no doubt, in Angola, that the TC exercises a true judicial or jurisdictional function, our Constitution of the Republic of Angola (CRA) in this aspect, fortunately, is clear in assigning the Court of Auditors the function of controlling the legality of public finances", said the professor this Tuesday.

According to the former Minister of State and Head of the Civil House of the President of the Republic, in the era of José Eduardo dos Santos, there is no doubt that "in terms of organic criteria, it exercises true jurisdictional control as well".

"And there can be no doubts about that, as to the type of control that is an external control, we have no doubts either", said this Tuesday Carlos Feijó, during a seminar alluding to the 21 years of the TC's existence.

The professor also said that "fortunately Angola has no problems and does not even discuss whether the prior visa or preventive inspection and some acts of the TC are jurisdictional acts or not, as happens in Portugal".

"A very debatable problem in Portugal is whether the prior visa or preventive inspection has a jurisdictional nature or is a merely administrative act, it is an interesting topic, but fortunately we in Angola do not have this debate".

"Fortunately in Angola, and I want to emphasize here, there is no doubt, between us, that the TC is a true court, it is a sovereign body that, under our CRA, is the supreme body for the inspection of public legality and for the judgment of accounts ", he stressed.

Carlos Feijó, who was speaking about the Draft Review of the Organic Law and the Court of Auditors' Process during a seminar alluding to the 21st anniversary of the Court of Auditors, stressed that "respect and consideration for the Court of Auditors is increasing", above all, "at the level of civil servants and agents".

Regarding the amendment of the Organic Law and the Court of Auditors' Procedure, the university professor highlighted the splitting of the concomitant and successive inspection chamber into two sections.

The first section, he explained, "will have mainly procedural instruction functions, with the preparation of an annual audit plan, inquiries and investigations".

The competence over the opinion on the General State and Social Security Account, as well as the supervision of the execution of the General State Budget (OGE), including the Social Security budget" is also part of the attributions of that section.

"And the second section must judge the processes of reintegrative financial responsibility and fines", concluded the also member of the Commission for the Reform of Justice and Law in Angola.
