Government admits that human rights have been violated by both parties in Lunda Norte

The Minister of Justice and Human Rights admitted this Wednesday that there had been human rights violations on both sides in the incident in Cafunfo, in the province of Lunda Norte, which left six dead, five injured and 16 detainees.

Francisco Queiroz was speaking at the end of a meeting held with civil society, in which the Minister of the Interior, Eugénio Laborinho, and the Commander-General of the National Police, Paulo de Almeida, also participated, about Saturday incidents in the Cafunfo sector, in the municipality do Cuango, in Lunda Norte, in a demonstration in which the popular are accused by the police of an armed rebellion.

According to the official, the analysis in terms of human rights has to be done from the perspective of the aggressor and the attacked, and the first "clearly had an impact on human rights".

"Nobody can take up arms, try to harm people's lives, we have to remember that a senior officer in the armed forces was attacked, he was close to death, he was set on fire with a handmade bomb and a police commissioner too, clearly there was an attack human rights there, in addition to other implications ", he said.

On the police side, the minister continued, the commander-in-chief of the National Police regretted the deaths, recognizing that "there was in fact this way of dealing with those who were no longer alive, those who were mobilized, unfortunately a practice that has to be magazine".

"The commander said that there will be an inquiry to hold those who acted in this way responsible," he said.

According to Francisco Queiroz, the dialogue was broader, more comprehensive, touching on issues that, although they are not very directly related, have to do with the situation. "It was a good dialogue, everyone was happy for the opportunity and recommended the continuation of this line of action," he said.

The holder of the Justice and Human Rights portfolio stressed that the Attorney General's Office is going to carry out its action "listening to people, collecting witnesses, evidence, organizing the process and giving the necessary progress".

Asked to comment on Tuesday, the commander-in-chief of the National Police on the proportionality of force, Francisco Queiroz considered "the role of the ungrateful police, because it is not always possible to reconcile what is at stake, which is the defense of the State, and human rights ".

The commander-general of the National Police said, Tuesday, that in the defense of the sovereignty of a state there can be no proportionality, as the jurists defend.

"This is very good in legal theory, we learned that in law. The State has no proportionality, when you are attacking the unit, the State, the symbol, is attacking the people", said Paulo de Almeida, stressing that " those who try to invade the police stations or any other institution to seize power, will have a prompt, efficient and disproportionate response from the National Police ".

Francisco Queiroz said that it is sometimes difficult to define the limits on the ground, when the police who are on top of the event, there are difficulties to "know how far their power goes, how far they have to respect human rights and sometimes unpleasant things happen ".

The minister stressed that what was at stake was the defense of a symbol of power, a police station and a national flag, which was to be replaced "with weapons, by a large group of people".

"So, proportionality is a difficult concept to use in this situation, it is almost an act of war, how am I going to war and will I be measuring proportionality, it is a little there that we have to analyze and see the operational difficulty that sometimes the police have. The police cannot be judging when they have to act, because otherwise when they wake up they’re dead ", he stressed.

Francisco Queiroz said that there will be a criminal investigation and another one from the point of view of police action.

According to the police, about 300 people linked to the Portuguese Protectorate Movement Lunda Tchokwe (MPPLT), which has been defending the autonomy of that region for years, tried to invade a police station on Saturday and in defense the forces of order and security killed six people .

The police version is contradicted by MPPLT leaders, opposition political parties and local civil society who speak of more than a dozen deaths.
