Activist “Ta Nice Neutro” sentenced to suspended sentence of one year and three months

The activist Gilson da Silva Moreira “Ta Nice Neutro” was sentenced this Wednesday to a suspended prison sentence of one year and three months for committing the crime of outraging the State, its symbols and organs.

The judgment of the activist, detained for nine months, was read this Wednesday by the judge in the case in the 1st section of the District Court of Luanda, which granted, as it was partially proven, the prosecution of the Public Prosecutor's Office (MP).

One year and three months in prison for committing the crime of outrage against the State, its symbols and organs was the penal framework presented by Judge Daniel Ferreira, who also suspended the execution of the sentence applied for a period of two years.

"Suspends (the court) the execution of the sentence imposed for a period of two years under the condition that the accused retracts to the injured entities in the process and in the same way within 15 days", said the judicial magistrate.

According to the court, it was proved that the activist "Ta Nice Neutro", 35 years old, committed the crime of outrage against the State, its symbols and organs for having called the President a "bandit and a clown" and for having given the same denomination to the effectives of the national police, in the videos that the activist recorded and shared on social networks.

"Ta Nice Neutro", also considered a "political prisoner", will have to record, within 15 days, a video to portray himself to the institutions and spread it on social networks, as it is the same route he used to "offend" institutions, "under penalty of being revoked the suspension of the sentence", recalled the judge.

"We do have the right to express our opinions, but we have a limit, we cannot offend people because they are also holders of constitutionally enshrined rights", stressed the magistrate.

In a period of two years, explained Daniel Ferreira, the activist "should not commit any crime nor be involved in situations that could take him to court", he warned.

The crimes of public instigation to the crime, rebellion and resistance against an official, of which he was also accused, underlined the judge, "have not been proved".

Mitigating issues such as the defendant's age, his health condition and his being a first-time defendant also contributed, the magistrate noted, to the suspension of the sentence.

The Luanda District Court also sentenced "Ta Nice Neutro" to pay a court fee of 50,000 kwanzas.

For its part, the MP expressed its dissatisfaction with the decision of the judge in the case and filed an appeal with the Court of Appeal, "which should immediately appear in the case file with suspensive effects".

This Wednesday, national police officers also restricted car circulation in the perimeter of the Luanda District Court, to inhibit demonstrations by activists, as happened last Thursday.
