Institutions ignore Ombudsman's recommendations, report notes

In 2019, the Ombudsman's Office made 14 recommendations, but the degree of compliance is "far below what is desirable," with most institutions not even responding to the appeals made.

The situation is expressed in the report to the 2019 National Assembly of the Ombudsman's Office, whose draft resolution was approved this Tuesday in parliament, with 173 votes in favor and five abstentions.

The document stresses that the effectiveness of the Ombudsman's intervention depends, above all, on the degree of cooperation of the entities addressed, which also determines the number of cases that should be carried forward to the following year and continue with the instruction process.

This position was defended by the Ombudsman, Carlos Alberto Pinto, in the presentation of the report, emphasizing that the cooperation of the entities addressed is crucial for the success of the intervention of the ombudsman's office and for the satisfaction of the legitimate interests of the citizens who have recourse to it.

Carlos Alberto Pinto said that in 2019, 505 cases were opened, to which 117 were carried over from 2018, totaling 622 cases, which ran in 2019.

According to Carlos Alberto Pinto, 221 cases were filed, with different grounds, of which about 60 cases were solved or clarified, and 14 recommendations were made.

A table in the report indicates that recommendations made to the Ministries of Health, Justice and Human Rights, Interior, Finance, the General Command of the National Police, the Provincial Government of Kwanza Sul, the Provincial Government of Luanda and the Directorate General of the Criminal Investigation Service were not answered.

In the year in question, the most recurring issues in the Ombudsman's Office's search for a solution were mainly related to social dramas, of which the procedural slowness, conflicts in legal-labour relations, land rights, with "the constant problem of access to and use of land raising points of disagreement between individuals and individuals or between individuals and public entities" should be highlighted.

The problem of pensions and the right of people who deduct for retirement purposes, but without a framework in the National Institute of Social Security, are also among the issues presented.

As in 2018, the courts lead the list of issues dealt with by the Ombudsman's Office, in 2019, with 131 cases, as opposed to 122 in the year prior to the analysis period, followed by labour disputes and land rights.

In the chapter on suggestions, the document calls for greater awareness on the part of the holders of public powers of the duty of cooperation with the ombudsman, under the terms of the Constitution and the Law, the valorization of the figure of the ombudsman by public institutions and their servants, as an essential institution for the administration of justice, the consolidation of the democratic State under the rule of law and good administration.

"That the legislative package regarding the ombudsman be approved, because it integrates new and important elements that contribute to the strengthening of the 'ombudsman' institution, which will allow a better service to the citizen, in line with the signs of our times," the report further suggests.
