Judiciary council dismisses judge who denounced “irregularities” in the CNE contest

The Superior Council for the Judiciary (CSMJ) decided on the dismissal of judge counselor Agostinho Santos, following a disciplinary procedure last November, where he was suspended for 90 days from exercising his functions.

The decision to dismiss Judge Agostinho Santos is part of the resolution of the fourth extraordinary session of the CSMJ permanent commission, held on December 15, 2022 and which Lusa had access to this Monday.

The body analyzed the final report of the disciplinary process, initiated last November against the counselor judge and decided "to apply the dismissal measure under the terms of the law that approves the Statute of Judicial Magistrates and Public Prosecution Service".

The magistrate was suspended from exercising his functions for a period of 90 days and with restrictions on accessing the body's premises, at the beginning of last November, for publicly denouncing "irregularities" in the tender for the appointment of president of the National Electoral Commission (CNE).

Agostinho Santos explained, last November to Lusa, that the suspension by the CSMJ was based on the interview he granted, on 25 March last to the Angolan portal "Camunda News" and the press conference he held on 11 May, where he reiterated the "irregularities" in the curricular contest for filling the position of president of the National Electoral Commission (CNE).

After the suspension, the judge counselor was heard, in November, by a member of the CSMJ and now this body has decided to dismiss him.

Agostinho Santos, the defeated candidate in the curriculum contest for the position of president of the CNE, in 2020, has been complaining for two years about "irregularities" in the contest.

For the judicial magistrate, who filed several cases with the CSMJ and the Constitutional Court, he was only defeated in the said curricular contest because 47 points were "illegally withdrawn", which until today asks for restitution, by the CSMJ, the entity that organized the contest.

The judge counselor even asked, last May, for the intervention of the President, João Lourenço, in the case, arguing that the current president of the CNE, Manuel Pereira da Silva, was declared the winner in a contest riddled with "several vices".
